1. Overview

This website is operated by 13648133 Canada Inc., trading as Love Statement Gifts ("Love Statement Gifts," "we," "us," or "our"). Shopify provides the ecommerce platform that allows us to offer this website, its content, products, and related services (collectively, the "Services"). By visiting or using the Services, or by placing an order, you agree to these Terms of Service and the policies referenced in them. If you do not agree, please do not use the Services.

2. Eligibility and accounts

You must be at least the age of majority in your place of residence to use the Services or place an order. Information you provide, including contact, billing, personalization, and shipping information, must be accurate and complete. You are responsible for safeguarding your account credentials and for activity under your account.

3. Products and personalization

Our products are personalized and made to order. Product photographs and descriptions are provided as accurately as reasonably possible, but color, finish, engraving placement, and appearance can vary slightly because of screen settings and the nature of personalized production.

You are responsible for checking all names, dates, wording, ring sizes, colors, fonts, symbols, and other personalization details before submitting an order. We normally engrave the information exactly as submitted. Changes or cancellations may not be possible once production has begun.

We may update descriptions, prices, options, or availability; limit quantities; or discontinue a product at any time.

4. Orders

Placing an order is an offer to purchase. An order is accepted after payment is authorized and we confirm acceptance. We may decline or cancel an order, including for suspected fraud, inaccurate information, product unavailability, or an engraving request that we cannot reasonably fulfill. If we cancel an order after payment, we will issue an appropriate refund.

Products are intended for personal or household use and not for unauthorized resale.

5. Prices and payment

Store prices are displayed in U.S. dollars unless stated otherwise. Prices, discounts, and promotions may change without notice. The amount shown at checkout, including applicable shipping and taxes, is the amount charged for the order. You confirm that you are authorized to use the payment method supplied and that your billing information is correct.

6. Shipping and delivery

We currently ship only to addresses in the United States. Each product is made to order, and production normally takes 3–4 business days after we receive complete order and engraving details. Completed orders are handed to our cross-border shipping partner twice weekly. USPS completes delivery within the United States.

Standard Shipping costs US$4.99. Estimated transit time is 5–8 business days after dispatch. Production time and any wait for the next carrier handoff are additional. Delivery dates are estimates and may be affected by carriers, customs, holidays, weather, remote destinations, or other circumstances outside our reasonable control. 7. Returns, refunds, and order problems

Because our products are personalized and made to order, we do not accept ordinary returns or exchanges for change of mind, except where required by applicable law.

If an item arrives damaged, contains an engraving error that differs from the details submitted with the order, or is the wrong item, contact us within 30 days of delivery. After reviewing the issue, we will arrange a remake or refund as appropriate. Please see our Return and Refund Policy for the full procedure. Nothing in these Terms limits rights that cannot legally be excluded.

8. Acceptable use

You may use the Services only for lawful personal purposes. You must not misuse the Services; interfere with their operation or security; transmit malicious code; collect information about others without authorization; impersonate another person; commit fraud; infringe intellectual-property or privacy rights; or use the Services in violation of applicable law.

9. Intellectual property

Unless otherwise stated, the website content, branding, text, graphics, product designs, photographs, and other materials are owned by or licensed to Love Statement Gifts and are protected by applicable intellectual-property laws. You may view the Services for personal, non-commercial use. No other use is permitted without prior written consent.

10. Third-party services and Shopify

The Services may use or link to third-party services, including payment providers and carriers. Their services may be governed by separate terms and privacy practices. Love Statement Gifts is powered by Shopify, but purchases from this store are transactions directly between you and Love Statement Gifts. Shopify is not the seller of our products and is not responsible for fulfillment of our orders.

11. Privacy

Our collection and use of personal information are described in our Privacy Policy. Information required to operate the store may be processed by Shopify, payment providers, carriers, and other service providers, including providers located outside your country of residence.

12. Errors and availability

We may correct typographical errors, inaccuracies, or omissions relating to descriptions, pricing, promotions, shipping charges, delivery estimates, or availability. If a material error affects an order, we may contact you for instructions or cancel and refund the affected order.

13. Disclaimer and limitation of liability

To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free access. To the fullest extent permitted by law, Love Statement Gifts and its directors, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Services or products purchased through them.

Some jurisdictions do not permit certain warranty exclusions or liability limits. In those jurisdictions, these provisions apply only to the maximum extent permitted by law. Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded.

14. Indemnification

To the extent permitted by law, you agree to indemnify Love Statement Gifts and its affiliates, directors, officers, employees, and service providers against third-party claims and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.

15. Termination

We may suspend or terminate access to the Services if we reasonably believe these Terms have been violated. Provisions that by their nature should survive termination will remain in effect.

16. Governing law

These Terms and any separate agreements through which we provide the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without limiting any mandatory consumer rights that apply in your place of residence.

17. Changes to these Terms

We may update these Terms by posting a revised version on this page. The effective date above will be updated when material changes are made. Continued use of the Services after an update constitutes acceptance of the revised Terms to the extent permitted by law.

18. Severability and entire agreement

If a provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms and the store policies referenced in them form the entire agreement concerning use of the Services and replace prior communications on the same subject.
